Girl sues Delta for allegedly dumping fuel on her from LAX flight - The Daily Breeze

A lawsuit was filed for a girl who was on a playground in South Gate when she was allegedly doused with fuel dumped by a Delta Air Lines jet in January.

The suit, filed in Los Angeles Superior Court on Monday, alleges negligence and intentional infliction of emotional distress and seeks unspecified damages.

The Tweedy Elementary School student was on a playground when the fuel landed on her clothes, flesh, eyes and skin – causing severe irritation, nose bleeds, nausea and stomach aches for days, the suit states.

A Delta spokesperson has said that the pilots were forced to dump fuel over an urban area to reduce the plane's weight before a successful emergency return landing.

The pilots of the Delta Boeing 777, headed from Los Angeles International Airport to Shanghai, had shut down one of the jumbo jet's two engines because of a compressor stall. Minutes later, the plane dumped fuel, and firefighters responded to a handful of schools to treat 60-plus children and staffers for skin irritation or other minor injuries, with no one reportedly going to a hospital, authorities said that day, according to the Daily Breeze.

Delta was obligated to adequately train and supervise their pilots and personnel and to properly operate the jet, including how to safely dump fuel, the suit states.

The pilots notified air-traffic control personnel that they needed to return to LAX, but negligently failed to inform them of any need to dump fuel, the suit alleges.

"Had they answered in the affirmative," the suit says, "the aircraft would have been directed to a location and altitude at which fuel could safely be jettisoned or approved to do so over the Pacific Ocean."

A 7-year-old girl caught in the line of fire during a robbery Tuesday near Hobby Airport is expected to be OK, police say.

The girl was playing with her brother as her family washed clothes at a washateria in the 8500 block of Broadway around 9 p.m., Houston Police Department Executive Asst. Chief Troy Finner said. At a nearby apartment, two men had robbed another man at gunpoint and were walking along Broadway when the robbery victim started following the pair, Finner said.

That's when one of the men pulled a gun and shot toward the robbery victim. A bullet fragment struck the child at the washateria in the stomach, Finner said.

The two men fled in a 2005 to 2007 Chevrolet Malibu, Finner said.

Paramedics rushed the child to a nearby hospital, where she was listed in stable late Tuesday.

"That does not erase our frustration and anger with suspects who do stupid things and have no regard to anybody," Finner said. "Shooting at somebody who they robbed, they hit a little girl. Thank God she's going to be alright."

The second-in-command vowed to capture the pair responsible, despite the global coronavirus pandemic affecting Houston.

"It's bad enough that we're dealing with COVID19 and everybody trying to keep people in their houses, keep their distance and keep safe," Finner said. "Don't ever think that because of what's going on here in Houston ... that the Houston Police Department is asleep. We're out here, and we're going to catch these suspects."
